What is a contract?
A contract is an agreement between two or more parties that creates mutual obligations. Examples include agreements, memoranda of understanding, letters of agreement, internship/externship agreements, and consulting agreements. Contracts do not have to involve money - even a written understanding between parties can be a contract.

I was mailed a document from someone I've asked to do some work for my program. Do I have the authority to sign this document?
Persons with authority to sign contracts will have received a written Delegation of Authority. You can find all current Delegations on our Delegations of Authority webpage. If your contract involves payment for services or goods, it must be processed through Procurement Services and signed by someone with procurement contract authority. If you're unsure whether you have signing authority, please contact our office.

How do I go about purchasing commodities or securing a service of some kind?
Contact Procurement Services to determine the appropriate purchasing process for your needs. They will advise whether your purchase requires a competitive solicitation based on the type and value of goods or services. If you're unsure whether you need Procurement assistance, contact our office or Procurement Services.

A consultant or vendor sent me a contract. Can I sign it and send it back?
No. All contracts must be sent to the Office of the General Counsel for legal review prior to signing, unless you are using a previously approved standard contract or template. If the contract involves payment for goods or services (a procurement contract), send it to Procurement Services first. They will forward it to our office for legal review if needed.

How can I obtain legal review of a document?
Submit documents for legal review by emailing legalreview@fgcu.edu. Please ensure your Dean/Director has approved the request before submitting. Include any relevant background information, deadlines, and the purpose of the agreement to help us provide timely review.
